Tax Recovery Process

If taxes remain unpaid after December 31 of the year that they were levied, the property is considered "in arrears".    

 

After more than one year in arrears (two years unpaid), a tax recovery notification is registered on title.   

If arrears are not paid by March 31 of the year following registration of the tax recovery notification, the municipality will offer the parcel for sale at Public Auction.

    • At any time until the Public Auction, anyone can pay tax arrears owing on the property. 
    • Once arrears are paid in full:
      • Property will be taken off of arrears list
      • Tax recovery notification on title will be discharged
      • Parcel will not go to Public Auction
If not sold at Public Auction, the County may take ownership of the parcel by filing "Tax Forfeiture" on title.  At this point, the parcel may still be sold as a Tax Recovery Property.

Legislation Supporting Tax Recovery

Part 10 of the Municipal Government Act (MGA) provides for three tax recovery processes:

  1. Recovery of Taxes Related to Land (Division 8);
  2. Recovery of Taxes Related to Designated Manufactured Homes (Division 8.1); and,
  3. Recovery of Taxes Not Related to Land (Division 9)

Terms & Conditions of Sale

Each parcel will be offered for sale subject to a reserve bid, and to the reservations and conditions contained in the existing certificate of title.

The land is being offered for sale on an “as is, where is” basis and the County of Grande Prairie No. 1 makes no representation and gives no warranty whatsoever as to the adequacy of services, soil conditions, land use districting, building and development conditions, absence or presence of environmental contamination, or the developability of the subject land for any intended use by the Purchaser. 

No bid will be accepted where the bidder attempts to attach conditions precedent to the sale of any parcel.  No terms and conditions of sale will be considered other than those specified by the County of Grande Prairie No. 1.  No further information is available at the auction regarding the lands to be sold.

Bidders may, prior to the Public Auction, access a report on possible presence of soil contamination by contacting the County of Grande Prairie No. 1; and

The parcel may be occupied and is offered for sale subject to the existing tenancy.

GST will apply to all properties subject to GST sold at the auction.

The successful bidder must, at the time of the sale, make a non-refundable ten percent (10%) deposit in cash, certified cheque or bank draft payable to the municipality, with the balance of the purchase price due within thirty (30) days of the sale.
